Adoption of Amendments
to
Mississippi Hazardous Waste Management Regulations (HW-1)

As authorized by Section 17-17-27, Mississippi Code of 1972, the Mississippi Commission on Environmental Quality will hold a public hearing on March 6, 2014 to receive comments on amendments to the Mississippi Hazardous Waste Management Regulations. The hearing will be held at 1:30 p.m. at the Mississippi Department of Environmental Quality, 515 East Amite Street, Commission Hearing Room, Jackson, Mississippi.

The proposed amendments have been published in final form in the following Federal Register notices: 77 FR 22229, April 13, 2012 – Hazardous Waste Technical Corrections and Clarifications Rule, 73 FR 64668, October 30, 2008 – Revisions to the Definition of Solid Waste, and 78 FR 46448, July 31, 2013 – Conditional Exclusions from Solid Waste and Hazardous Waste for Solvent-Contaminated Wipes.

The Hazardous Waste Technical Corrections and Clarifications Rule addresses amendments that are included under Parts 261 and 266 to take final action on two technical amendments – A correction of the typographical error in the entry “K107” in a table listing hazardous wastes from specific sources and a conforming change to alert certain recycling facilities that they have existing certification and notification requirements under the Land Disposal Restrictions regulations. Four other technical amendments that were withdrawn in the June 2010 partial withdrawal notice will remain withdrawn unless and until EPA determines action is warranted in the future.

The Revisions to the Definition of Solid Waste Rule revises the definition of solid waste to exclude certain hazardous secondary materials from regulation under Subtitle C of the Resource Conservation and Recovery Act (RCRA), in order to encourage safer recycling and resource conservation. The rule revision responds to several court decisions concerning the definition of solid waste.

The Conditional Exclusions from Solid and Hazardous Waste for Solvent-Contaminated Wipes Rule conditionally revises the definition of solid waste to conditionally exclude solvent-contaminated wipes that are cleaned and reused and revises the definition of hazardous waste to conditionally exclude solvent-contaminated wipes that are disposed.

Additionally, amendments are being made that correct previous errors and omissions in the regulations. Examples of the errors and omissions are: The transposing of page numbers (i.e., 1219 instead of 1291), the entry of the same regulatory citation twice necessitating the removal of one of the citations, the omission of a citation (a citation should have been made in Part 261 and Part 262 but was omitted in one of the Parts), and the incorrect placement of a citation in a Part.
