NOTICE OF NON-DISCRIMINATION

MDEQ does not discriminate on the basis of race, color, national origin, disability, age, or sex in administration of its programs or activities, and, MDEQ does not intimidate or retaliate against any individual or group because they have exercised their rights to participate in actions protected, or oppose action prohibited by federal law or regulation or for the purpose of interfering with such rights.

MDEQ’s Executive Director is responsible for coordination of compliance efforts and receipt of inquiries concerning non-discrimination requirements implemented by federal law and regulation.  If you have any questions about this notice or wish to file a complaint, you may contact:

If you believe that you have been discriminated against with respect to a MDEQ program or activity, you may file a written complaint with MDEQ Executive Director and request a hearing in accordance with Miss. Code Ann. §§ 49-17-35 and 49-17-29, as applicable.  A formal complaint must be filed within 30 calendar days of the alleged occurrence, or when the alleged discrimination became known to the complainant.  The complaint must meet the following requirements:

  1. A complaint and/or a hearing request shall be in writing and signed by the complainant(s).
  2. Include the date of the alleged act of discrimination, or the date the complainant(s) became aware of the alleged discrimination, or the date on which the conduct was discontinued or the latest instance of the conduct.
  3. Present a detailed description of the issues, including the names and job titles of those individuals perceived as parties in the complained of incident, and the applicable program or activity that the alleged act of discrimination is regarding. The complaint must include whether the alleged act of discrimination is on the basis of race, color, national origin, disability, age, or sex, or other federally protected class.

After proper receipt of the complaint and/or hearing request, the appropriate MDEQ hearing procedures will be followed.  These procedures do not alter any complainant’s ability to file a complaint directly with the appropriate federal assistance agency in accordance with that federal agency’s regulations.

Any person requesting language assistance or handicapped accommodation may make a request to any MDEQ staff or direct the request specifically to the MDEQ Executive Director.
